 On a separate matter, our associate in Tokyo has advised that the rejection of the applications in Japan have become final. You may recall that those applications were rejected on the grounds that the word "Sakai" is a common Japanese term that is not (in the view of the Japanese Trademark Office) capable of acting as a trademark. The deadline for appealing the decision is October 23, 2009. Based on our prior discussions, I do not believe that we have sufficient evidence to make any appeal successful. I will mark my calendar for one year. I suggest that we re-visit the issue of the Japanese trademarks then. If we can prove sufficient use of the trademarks directly in Japan (i.e., distribution of software or other services directly to Japanese users as opposed to general internet usage) then we can potentially file new applications and overcome the rejections.
